Personal Injury

Sometimes automobile or light truck accidents occur when there is only one car involved and no surviving witnesses to testify as to what happened or at least no other driver to testify as to what caused the accident. The victims of these accidents often do not pursue any claim because they assume there was no one at fault except the driver of the single vehicle involved in the accident. Occasionally though, there is a party at fault besides the driver.

The issues that surface in such cases involve the crashworthiness of the vehicle involved or sometimes the roadway itself. Regardless of what caused the accident there is a question of what caused the driver's injuries. Were the injuries caused by the accident itself or by a failed seat belt, collapsed roof, unsafe design, or some other such thing? These questions can even arise when the accident involves two or more vehicles and the injured person appears to be at fault in the accident.

Cases such as those I just described are expensive to investigate and litigate and in order to justify the out of pocket costs the injury must be severe, i.e. resulting in death or life changing injury such as paralysis, severed limb, etc.

If you or someone you know has been involved in such an accident, The Law Offices of Darrell L. Castle & Associates would like to investigate for possible crashworthiness issues. There is no charge for the consultation.

DILANTIN

Dilantin is an anti-epileptic drug which is sometimes referred to as an anticonvulsant. Dilantin has allowed many patients who have epileptic seizures to slow the rate of seizures or prevent them while taking the drug by slowing the impulses in the brain that cause seizures. Most, if not all drugs, have some adverse side effects; the side effects of Dilantin can be extremely severe.

It has been linked with a rare skin disorder called Stevens Johnson Syndrome (SJS) or Toxic Epidermal Necrolysis (TEN) in some users. Both of these conditions are extremely serious and can leave their victims horribly disfigured or even dead. Stevens Johnson Syndrome is a severe allergic reaction characterized by inflammation of the mouth and throat which can lead to the conditions mentioned above.

Dilantin also can have side effects besides or in addition to SJS and TEN such as liver damage, hallucinations, irregular heartbeat, birth defects, and skin rash. If you or someone you know has used the anti-epileptic drug Dilantin and has Stevens Johnson Syndrome call or contact by email the Law Offices of Darrell L. Castle and Associates for a free appointment to discuss your possible case. You may be entitled to compensation from the manufacturer of this drug.

GARDASIL FOR BOYS
Posted by: Darrell Castle
October 19, 2009

That's right, Gardasil, a vaccine used to prevent cervical cancer in women, recently won FDA approval for use in boys. The FDA has cleared the vaccine for use in males ages 9 to 26 said the drug's manufacturer, Merck & Co. Gardasil is given mainly to school age girls to prevent cervical cancer but it has generated 16000 adverse event reports including 43 which resulted in death.

Sales of Gardasil declined 5% last year and Merck could be looking for ways to revive sales by opening up boys to Gardasil injections. Merck won FDA approval on the grounds that Gardasil will help prevent genital warts in boys but this could prove to be a tough sale given the drug's record with girls. It is estimated that FDA approval for Gardasil will add 200 to 300 million dollars in annual sales for Merck. Gardasil generated revenue of 1.4 billion dollars last year.

Another reason Gardasil for boys may not sit well with America's parents is the estimated cost of $400 per injection. Merck has a rebate program for those without health insurance to help with the cost. No wonder health insurance is expensive and unaffordable for so many people. This comes at a time of rising unemployment and increasing numbers of uninsured people because so many are out of work. I wonder what could make this vaccine cost $400 per injection. I wonder what is in this vaccine. What are its ingredients? The public should at least be made aware of what is being injected into their children.

Lawsuits have already been filed claiming damages for Gardasil problems. Contact the Law offices of Darrell L. Castle & Associates for a free consultation.

Manufactured by Merck & Company, Gardasil is a vaccine designed to prevent HPV (human papillomaviruses) but according to one of the leading researchers on the vaccine the incidence of serious adverse events associated with Gardasil is greater than the incidence rate of cervical cancer. Merck touts Gardasil as being effective in the prevention of cervical cancer but according to clinical studies it has not proven to reduce the incidences of cervical cancer.

It is associated with numerous side effects including blood clots, severe allergic reactions, Guillan-Barre' Syndrome, autoimmune disorders, and even death. The vaccine was approved by the FDA in June of 2006 and since then more than 16000 adverse event reports have been with the Vaccine adverse event reporting system which is jointly operated by the FDA and the Centers For Disease Control. More than 6% of the reports were considered serious including 43 deaths.

Gardasil has been shown effective against some strands of HPV but ineffective against many others. In addition its protection, when there is any, has only been proven effective for 5 to 7 years which could give a false sense of security to young women.

Lawsuits have been filed for serious adverse events after Gardasil vaccination. Should you desire a free consultation regarding Gardasil contact the Law Offices of Darrell L. Castle & Associates.

YAZ and Yasmin Part Two
Posted by: Darrell Castle
October 01, 2009

The New York Times of Saturday, September 26, 2009 published an article entitled "Health Concerns Over Popular Contraceptives." In this article the Times writer pointed out that the contraceptives YAZ and Yasmin have been marketed by Bayer as more than just contraceptives. "YAZ , in particular, the top selling birth control pill in the United States owes much of its popularity to multi-million dollar ad campaigns that have promoted the drug as a quality-of-life treatment to combat acne and severe premenstrual depression." Bayer HealthCare had about 1.8 billion dollars in sales last year from Yaz based on successful positioning of Yaz and Yasmin as the go to drug brands for women under 35.

Many women allege severe symptoms from taking these drugs including blood clots, stroke, heart disease, gall bladder disease and others. Bayer asserts that the testing of its drugs indicates safety and promises to defend the lawsuits vigorously. I wonder if there are any women in the Memphis Tennessee area who believe that they have been injured by these drugs. I intend to find out by running a TV campaign inviting women to come forward for a consultation if they believe that they have suffered severe symptoms while taking Yaz, Yasmin, or their genericcounterparts.

YAZ and Yasmin Part One

If you are a recent user of Yaz, yasmin, or ocella birth control pills you may be at elevated risk of severe, potentially fatal conditions. The Food and Drug Administration (FDA) sent a letter to Bayer warning it regarding its false advertising practices. The letter found that the TV ads by Bayer broadened YAZ's indications, overstated its efficacy, and minimizes its serious risks, in violation of the Food, Drug, and Cosmetics Act, 21 U.S.C. 352(n) & (f)(1), and 321(n) and the FDA'S implementing regulations.

Moreover, the FDA letter suggested that Bayer minimized the risk of side-effects in YAZ ads. Risk disclosures were accompanied by distracting visuals, numerous scene change and other modalities such as background music that interfered with the message. According to the FDA, these practices made it difficult for the viewers to process and comprehend the seriousness of risks associated with the use of YAZ.

The problems caused by YAZ and Yasmin are due to the presence of DRSP. This compound impacts the body's normal mechanism of regulating the balance between salt and water. This results in elevated potassium levels, a condition known as hyperkalemia. Medical literature indicates that YAZ and Yasmin-induced hyperkalemia can disrupt heart rhythms, slow down blood flow, and cause clots. Those clots could lead to significant potentially life-threatening heart problems and other health issues.

The Side Effects of YAZ and Yasmin Include:

  • Heart Attacks
  • Strokes
  • Cardiac Arrhythmias
  • Deep Vein Thrombosis
  • Pulmonary Embolism
  • Gallbladder Disease
  • Sudden Death
  • Symptoms of Blood Clots Could Include:
  • Sudden Severe Headaches
  • Unusual Swelling or Pain in the Legs or Arms
  • Sharp or Crushing Chest Pain or Coughing Blood
  • Eye Problems Such as Blurred or Double Vision or Complete Loss of Vision
  • Pain in The Back of the Lower Leg
  • Symptoms of Gallbladder Problems Could Include:
  • Pain Or Discomfort In the Upper Right Side of the Abdomen
  • Nausea
  • Diarrhea
  • Abdominal Bloating
  • Jaundice

If you are a recent user of YAZ or Yasmin and you have experienced any of these symptoms, KNOW YOUR RIGHTS. Contact The Law Offices of Darrell L. Castle & Associates.
